WELCOME TO THE MAESTRA WEBSITE (hereinafter referred to as “the Site”)
By accessing or using the Site, you are acknowledging that you have read, understand, and agree, without limitation or qualification, to be bound by the Terms and Conditions mentioned on the Site. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS, YOU MAY NOT USE OUR SITE.
1. ELIGIBILITY AND USAGE
- Age of Majority: You must be 18 years old or the age of majority in your jurisdiction to make a purchase. If you are under age, you may not make a purchase on the Site.
- Personal Use: Products, services, and samples are for personal and/or professional use only. You shall not sell or resell any products or samples you receive from us.
- Order Governance: We reserve the right, with or without notice, to cancel or reduce the quantity of any order that we believe, in our sole discretion, may result in the violation of our Terms and Conditions.
2. PRODUCT DESCRIPTIONS AND ERRORS
We attempt to be as accurate as possible; however, we do not warrant that product descriptions, colours, or information are accurate, complete, or error-free. This Site may contain typographical errors or inaccuracies. MAESTRA reserves the right to correct any errors, inaccuracies, or omissions (including after an order has been submitted) and to change or update information at any time without prior notice. This includes pricing and availability; we reserve the right to refuse or cancel any order placed based on incorrect information.
3. INTELLECTUAL PROPERTY (TRADEMARKED)
All information and content available on the Site, including but not limited to trademarked names (“MAESTRA”), logos, service marks, text, graphics, button icons, images, audio clips, data compilations, and software (collectively, the “Content”) is the property of MAESTRA, our affiliates, or licensors, and is protected by Indian and international laws.
- Prohibitions: Except for the limited license below, neither the Content nor any portion of the Site may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited without our prior express written consent.
- Linking Policy: You are granted a limited, non-exclusive license to create a hyperlink to our home page for personal, non-commercial use. You must not misrepresent your relationship with us or portray MAESTRA in a derogatory or offensive manner. We may, at our discretion, require you to remove any link to the Site immediately upon request.
4. USER CONTENT AND “SUBMISSIONS”
- Unsolicited Ideas: It is our policy to decline unsolicited suggestions. However, any feedback or “Submissions” you provide will be treated as non-proprietary and non-confidential.
- License to Content: When you transmit or tag MAESTRA in “User Content” (photos, videos, or messages) on social media platforms like Instagram or Facebook, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, modify, and display your content for marketing purposes.
- Warranties: You represent that you own the rights to your Submissions and that they do not contain software viruses or “spam.” You agree to indemnify us for all claims arising from your Submissions.
5. THIRD-PARTY LINKS
We are not responsible for the content of any off-website pages or any other websites linked to or from the Site. Your linking to any off-site pages is at your own risk. We do not warrant the offerings of third-party websites and assume no liability for their actions, products, or privacy policies.
6. USER CONDUCT AND RESTRICTIONS
You agree not to engage in or encourage others to:
- Upload or transmit content that is unlawful, harmful, defamatory, or racially/ethnically objectionable.
- Impersonate any person or entity, including a MAESTRA representative.
- Stalk, harass, or harm any third party or minors.
- Use software robots, spiders, or crawlers to extract data or impose an unreasonable load on our infrastructure.
7. PAYMENT TERMS
Payments may be made via:
- UPI, Credit Cards, Debit Cards, Net Banking, Wallets, e-Gift cards, and reward points.
- Cash On Delivery (COD) is available for limited areas only.
- All online payments are handled by authorized Payment Gateways following RBI security measures. MAESTRAis not responsible for any breach of information or inappropriate transactions at the gateway level.
8. SHIPPING AND DELIVERY
- Timeline: Orders are usually delivered within 7 to 10 working days.
- Fees: Shipping fee will apply to orders below a specific amount. COD fees may apply regardless of order value.
- Risk of Loss: The risk of loss and title for products passes to you upon delivery. We are not responsible for non-delivery caused by incorrect or incomplete information provided by the customer.
9. CANCELLATIONS, RETURNS, AND SOCIAL MEDIA POLICY
- Refund Policy: No refunds shall be entertained, considering the nature of the product. Credit notes are issued only for defective products.
- Unboxing Video Requirement: To claim a defect, you must provide a continuous unboxing video showing the intact parcel, labels, and the outer MAESTRA packaging being opened.
- Social Media Clause: You shall not take to social media (Facebook, Instagram, YouTube, etc.) to disparage the MAESTRA brand by posting images or content regarding damaged products before resolution. If this policy is violated, we reserve the right to refuse any credit note or replacement.
- Allergy Claims: No refund for infections/allergies unless accompanied by a doctor’s certificate stating the infection was caused specifically by the MAESTRA product and not a pre-existing condition.
10. LIMITATION OF LIABILITY AND INDEMNIFICATION
- “As Is” Basis: The Site and its contents are presented “as is.”
- Liability Cap: Neither we nor our affiliates will be liable for business interruptions, data non-delivery, or system failures. Our maximum aggregate liability shall not exceed Rs. 10,000/-.
- Indemnity: You agree to defend and hold MAESTRA harmless from any loss, damages, or costs resulting from your violation of these terms or your use of the Site.
11. DISPUTES AND GOVERNING LAW
- Jurisdiction: These terms are governed by the laws of India. Actions shall be performed within Mumbai, India.
- Arbitration: Any dispute shall be submitted to arbitration in Mumbai under the Arbitration and Conciliation Act, 1996 (Amendment 2019). You agree to individual arbitration and waive the right to a class-action lawsuit.
12. ELECTRONIC NOTICES
You consent to receive all notices, agreements, and disclosures electronically via email or mobile number. This consent overrides any DNC (Do Not Call) registrations under TRAI.
13. GENERAL PROVISIONS
These Terms and Conditions constitute the complete and exclusive agreement between us. We reserve the right to change these terms at any time by posting changes on the Site. Your continued use of the Site constitutes agreement to these changes.
